Article 2. Our products

SENHO sells furniture products for all rooms of the home to consumers and non-professional buyers.

Each product available for purchase is described as accurately as possible on its own specific product description page.

Before placing an order, we invite you to carefully review the product description and characteristics (in particular its dimensions, materials, functions and finishes).

In most cases, you will need to assemble our products yourself.

We take care to prepare our assembly instructions so that they are as simple and clear as possible.

We expressly recommend that you carefully read the instructions and documents supplied with the products.

We shall not be held liable for damage resulting from use of the products that does not comply with the instructions set out in the instructions and documents supplied with the products.

If you have any doubts about how to use the product, you can contact SENHO customer service by email (serviceclient@senho.fr).

All our product assembly instructions are available online on the SENHO websites.

Article 3. Our prices

The prices displayed on the SENHO websites include all taxes (VAT included), excluding delivery charges, and include the cost of waste disposal (eco-contribution) where applicable.

Delivery charges are specified in the shopping cart and confirmed when the order is validated. Delivery charges are invoiced at the end of the ordering process and are added to the price of the products ordered. Delivery charges vary depending on the Customer’s delivery address, the weight of the goods ordered and the level of service selected by the Customer (collection point, delivery outside the home or delivery directly to the door of your home).

SENHO reserves the right to change its prices at any time, but products will be invoiced on the basis of the prices in effect at the time the orders are registered, subject to availability at that time.

Where the purchase of the products is accompanied by credit applied for at the time of the sale or before the sale, the sale will only become final once the credit offer itself becomes final.

Article 4. Your order

To place an order on the SENHO websites, you must complete several steps.

Step 1: select one or more products.

Step 2: fill your shopping cart and access its contents, which include all selected products.

Step 3: complete the mandatory fields in the identification and information forms.

In this respect, you undertake to provide us with accurate and reliable information, thereby enabling us to fulfil all our contractual obligations. We cannot be held liable if the information you have provided proves to be false or incomplete.

Step 4: validate the order by clicking on the dedicated button.

Step 5: pay for the order.

Any order constitutes acceptance of the General Terms and Conditions of Sale, the prices and the descriptions of the products available for sale.

The data provided by the Customer and recorded by SENHO during registration and ordering constitute proof of the transactions between the SENHO websites and the Customer. Once the Customer has validated the order, SENHO will send the Customer a confirmation email notifying them that the order has been successfully registered.

SENHO reserves the right to refuse to carry out a delivery or fulfil an order where the Customer has not paid all or part of a previous order, or where a payment dispute remains unresolved.

The selection and purchase of a product by the Customer are the Customer’s sole responsibility. Consequently, the total or partial inability to use the products, particularly due to incompatibility of the equipment, cannot give rise to any compensation, refund or liability on the part of the SENHO websites, except in the event of a proven hidden defect, non-conformity, defectiveness or exercise of the right of withdrawal.

Product offers are subject to availability, as specified when the order is placed.

If the ordered product is unavailable, we undertake to inform you as soon as possible and may, where possible, offer replacement products or refund the product (including delivery charges) within a maximum period of 30 days.

Article 5. Payment

On the SENHO websites, you can pay for your order by bank card (Carte Bleue, Visa, Mastercard, American Express), wallets (Apple Pay, PayPal), crypto (USDC), local payment methods (Bancontact, Klarna, TWINT), gift card(s) or SENHO store credit card.

Please note that SENHO may change the payment methods it offers.

In the event of payment by bank card, the Customer’s order will only be validated once the account has been debited following authorisation from the relevant payment centres. If authorisation is refused, the Customer’s order cannot be processed.

Online payment by payment card is carried out via a secure system that enables the Customer’s bank details to be encrypted when transmitted over the network.

For more information, please consult our Privacy Policy.

Article 6. Delivery

Delivery will be made to the address you provided when placing your order.

Once the order has been validated, the Customer will receive, within an indicative period of two (2) business days, an SMS from the carrier in order to select a delivery time slot. It is the Customer’s responsibility to check that this message has been received, including in their junk mail or spam folder.

As the Products are bulky, the Customer or a person authorised by the Customer must be present at the time of delivery.

Once the delivery time slot has been confirmed by the Customer with the carrier, delivery will take place within an indicative minimum period of three (3) to six (6) business days, depending on the Customer’s availability and the carrier’s logistical constraints.

Delivery times are calculated in business days (Monday to Friday, excluding public holidays). Delivery times run from the day following payment of the order, subject to acceptance of the payment.

We undertake to use all necessary means to comply with the stated delivery dates. Accordingly, if we are informed of a delivery delay, we undertake to notify you as soon as possible. You will then decide whether to maintain or cancel all or part of your order. If your order is cancelled, it will be refunded within a maximum period of thirty (30) days following receipt of the request.

“ECO” delivery means delivery of the product outside your home or at the entrance of your building. No handling operations, including delivery to an upper floor, or installation will be carried out by the carrier. You will therefore be responsible for collecting, storing and installing the products in your home.

SENHO also offers “STANDARD” delivery, allowing Customers to receive their orders in the room of use. This additional service is subject to a specific charge which varies according to the address and weight of the parcels.

The Customer may track the progress of their order directly on the carrier’s website, using the tracking link or tracking number provided by SENHO or the carrier.

Only the carrier is authorised to determine the most appropriate unloading location.

Article 7. Delivery liability and conformity

SENHO undertakes to bear the risks associated with storage and transport until the designated delivery location. Customers are responsible for the goods delivered as soon as they are physically handed over, with the transfer of possession resulting in the transfer of risks associated with transport.

Upon delivery, the risks of loss and deterioration of the purchased goods, as well as any damage they may cause, are transferred to the Customer.

SENHO cannot be held liable for the Customer’s failure to comply with the delivery arrangements and appointments that the Customer has personally arranged with the carrier.

If the Customer or the person authorised by the Customer is absent during the delivery time slot agreed with the carrier, or if delivery cannot be completed for reasons attributable to the Customer (incorrect or incomplete address, inaccessible or non-compliant access, failure to respond to the carrier’s requests, unjustified refusal of the goods, etc.), a new delivery attempt will have to be arranged.

For deliveries carried out by carriers specialising in bulky products (including Tamdis, VIR, GLS or any equivalent carrier), only one delivery attempt is included by default.

Any second delivery attempt may result in additional charges corresponding to the actual costs incurred by SENHO, including in particular rescheduling, temporary storage and transport costs, according to the rates applied by the relevant carrier. As an indication, these charges may range from EUR 50 to EUR 120 including VAT, depending on the nature of the Products, the delivery area and the carrier used.

In the event of an unjustified refusal of delivery by the Customer, SENHO reserves the right to consider the order cancelled due to the Customer’s actions. In such a case, outbound transport, return transport, handling and, where applicable, storage costs will remain payable by the Customer and may be deducted from any refund due.

In order to confirm the conformity of your order upon delivery, it is important that, in the presence of the carrier, you check that the products correspond both to the delivery note and to the goods ordered:

  • the number of parcels and the apparent condition of the parcels,
  • the condition of the products inside the parcels.

If the delivery is compliant: indicate on the delivery note that the packaging and products are in good condition, date the document, clearly state your name and sign the delivery note.

If the delivery is non-compliant: indicate on the delivery note the issue encountered: service not provided, product damaged after unpacking, incomplete product, etc.

If you refuse the product, please clearly state the reason or reasons for the refusal.

Article 8. Returns policy, right of withdrawal

Returns accepted within 14 days

You have 14 days from receipt of your order to request the return of your product.

To be accepted, the product must be returned:

in its original packaging or equivalent packaging,
and suitable for resale.

Free return shipping

Return shipping is free when the return is carried out in accordance with the procedure provided by our customer service team.

📧 serviceclient@senho.fr

Our customer service team will provide you with the steps to follow and, where necessary, arrange collection of the product with our carrier.

Important: please do not return the product using your own means before receiving our instructions, in order to avoid any loss or transport error.

No restocking fees

No restocking fees will be charged for an accepted return.

No final sale items

No item sold on our website is considered a final sale item.

Right of withdrawal

In accordance with the French Consumer Code, you have a 14-day right of withdrawal from receipt of your order, without having to provide any reason for your decision.

To exercise this right, please contact us by email at:
📧 serviceclient@senho.fr

The return must then be carried out in accordance with the conditions set out in this policy.

Article 9. Refunds

After receipt and inspection of the returned product, the refund will be issued to the payment method used for the order, unless otherwise agreed between the Customer and SENHO.

The refund may be deferred until the product has actually been recovered or until proof of return shipment has been received.

If the returned product is incomplete, damaged, dirty or used, or if its packaging has been damaged beyond what is necessary for normal opening, SENHO may refuse the refund or issue a partial refund.

Article 10. Warranties

The Customer benefits from the legal guarantee of conformity as well as the guarantee against hidden defects in accordance with the applicable legal provisions.

10.1 The legal guarantee of conformity

The legal guarantee of conformity is a guarantee covering all conformity defects already existing on the date the product is delivered. Customers have 2 years after delivery or purchase of the goods to invoke the guarantee. This procedure is free of charge.

The defect is automatically presumed to have existed before the product was purchased. The Customer therefore does not have to provide proof of the date on which the defect appeared. Nevertheless, the legal guarantee of conformity applies provided that the alleged defects are reported to SENHO as soon as they appear. The Customer must also provide evidence of the existence of the defects by sending photographs, videos or any other evidence of the problems encountered.

After examining the evidence of the existence of the defects, our technical department must confirm that the product is indeed the same product that was sent to you, without damage, modification or intervention of any kind, and that the defect relied upon by the Customer does not result from:

  • abnormal or improper use,
  • normal wear and tear or ageing,
  • an accidental event or, more generally, an external cause (such as intervention by any unauthorised third party on the product or a defect linked to abnormal or improper use of your product).

If the defect becomes apparent more than 2 years after delivery, the presumption no longer applies and the Customer will be required to prove not only the existence of the defect but also that the defect existed before delivery of the product.

The Customer may choose between repair and replacement of the goods. In the event of an obvious difference in cost between the 2 options, SENHO may impose the less expensive option. For example, if shipping replacement parts is less expensive than sending a new item of furniture, SENHO may require replacement parts to be shipped. Repair or replacement of defective products is carried out at no cost to the Customer.

The Customer may obtain a full or partial refund only in the following three cases:

  • if repair is impossible (for example if production has been discontinued),
  • if the repair or replacement cannot be carried out within one month following the Customer’s complaint,
  • if the repair or replacement causes a major inconvenience to the Customer.

Which defects are covered by the legal guarantee of conformity?

  • goods that are unfit for the use normally expected of similar goods,
  • goods that do not correspond to the description provided by SENHO, even if they function perfectly,
  • goods that do not possess the qualities advertised by SENHO or agreed with it,
  • goods that have a manufacturing defect, imperfection or incorrect assembly.

In which cases does the legal guarantee of conformity not apply?

  • the Customer was aware of the defect at the time of purchase,
  • the Customer could not have been unaware of the defect at the time of purchase,
  • the defect results from materials supplied or added by the Customer,
  • the Customer makes their claim more than two years after purchase or delivery,
  • for self-assembly furniture or flat-pack furniture, the guarantee applies to each individual component of the furniture, considered separately; it does not apply to the furniture once assembled unless the defect results from the assembly instructions,
  • professional use and, more generally, any activity of a non-domestic nature.

What damage is excluded from the guarantee?

  • damage caused by an external cause unrelated to the product,
  • damage resulting from failure to comply with the assembly instructions or from installation that does not comply with the manufacturer’s instructions, poor quality of the appliance’s power supply, lack of ventilation (blocked ventilation openings or insufficient space required for ventilation),
  • damage caused by a lack of maintenance,
  • components or accessories requiring regular replacement (batteries, rechargeable batteries, filters, lamps, etc.),
  • damage occurring during transport or relocation of the product carried out by the Customer or a third party under the Customer’s responsibility.

10.2 Guarantee against hidden defects

SENHO is liable under the guarantee against hidden defects affecting the products sold which render them unfit for their intended use, or which so substantially impair that use that the buyer would not have purchased them, or would only have paid a lower price for them, had they known of the defects.

Any action arising from hidden defects must be brought by the purchaser within two years from discovery of the defect. If the Customer provides proof of the existence of a hidden defect, the Customer may choose between cancellation of the sale or a reduction in the sale price.

Article 11. Data protection

We respect the privacy of our users and ensure that all information collected which enables them to be identified is treated as confidential information.

The term “personal data” refers to information relating to the Customer as a natural person, voluntarily provided by the Customer. Personal data therefore includes identifying information (such as surname, first name, email address, postal address, telephone number, etc.).

SENHO attaches great importance to protecting and respecting the privacy of its Customers and their personal data. The personal data protection policy of the SENHO websites is intended to inform Customers about practices relating to consent, collection, use, storage, security measures, retention period(s), recipient(s), the placement of cookies on their devices and the sharing of personal data that the Customer may be required to provide when making a purchase, joining a loyalty programme, creating a Customer account, etc.

We invite you to consult the details of our Privacy Policy and Cookie Management Policy on the website.

We therefore collect the Customer’s personal data for the purposes of processing their order, issuing invoices, conducting satisfaction surveys, identifying the Customer and managing commercial relations with the Customer. SENHO is the controller of this data.

SENHO reserves the right to verify the Customer’s identity.

SENHO complies with its formalities and record-keeping obligations in relation to its processing activities. The Customer has the right to access, modify and delete personal data concerning them. This right may be exercised by contacting us by email at serviceclient@senho.fr.

Article 12. Eco-contribution – Waste Furniture Items (DEA)

The prevention and management of waste furniture items (DEA) are governed by the principle of extended producer responsibility (EPR), as provided for under the applicable national regulations in the Member States of the European Union in which SENHO places Products on the market.

In France, this system is governed in particular by Articles L.541-10 et seq. and R.543-240 et seq. of the French Environmental Code.

In accordance with these provisions, SENHO is a member of the approved eco-organisation Ecomaison (formerly Éco-mobilier) for the management of its waste furniture items.

SENHO is registered under the unique identifier: FR359112_10IDQH.

In this respect, SENHO collects a DEA eco-contribution from its Customers when they purchase new Products placed on the French market and pays it to the relevant eco-organisation in order to finance the collection, sorting, reuse and recycling of waste furniture items.

The amount of the DEA eco-contribution is indicated on each product page, close to the sale price.

It depends in particular on the materials used, the net weight of the Product and the applicable rates.

For Products placed on the market in other Member States of the European Union, SENHO complies with the applicable local EPR obligations relating to waste furniture items.

Article 13. Eco-contribution – Recycling of household packaging

Under the principle of extended producer responsibility (EPR), SENHO is also required to contribute to the financing of the management and recycling of the household packaging of the Products it places on the market.

France

In France, SENHO is a member of the approved eco-organisation Léko for the management of household packaging.

SENHO is registered under the unique identifier: FR359112_01BVPG.

In this respect, SENHO pays Léko an annual eco-contribution calculated in accordance with the applicable rates, based on the characteristics of the packaging placed on the French market.

Germany

For Products placed on the German market, SENHO is registered with the national LUCID packaging register, in accordance with German packaging legislation (Verpackungsgesetz).

LUCID registration number: DE2066856359857.

In this respect, SENHO complies with its declaration and contribution obligations with an approved eco-organisation in Germany for the management and recycling of packaging.

Other European Union countries

For Products placed on the market in other Member States of the European Union, SENHO complies with the applicable local regulations relating to packaging EPR and, where applicable, contributes to national collection and recycling schemes.

Article 14. Intellectual property

All elements of the SENHO websites, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of SENHO.

Any person who operates a website, whether for personal or professional purposes, and who wishes to place on their website, for personal or professional use, a simple link leading directly to the home page of the SENHO websites must first obtain SENHO’s authorisation.

However, any hyperlink to the SENHO websites using framing or inline linking techniques is strictly prohibited. In all cases, any link, even if tacitly authorised, must be removed upon simple request from SENHO.

Hyperlinks may lead to websites other than the SENHO websites. SENHO accepts no liability where the content of such websites breaches applicable laws and regulations.

Article 15. Applicable law, severability of clauses and legal provisions

These General Terms and Conditions of Sale shall be performed and interpreted in accordance with French law.

Before initiating any legal proceedings, the parties will seek to reach an amicable agreement. Failing such an amicable agreement, any dispute of any nature or any dispute relating to the formation or performance of the order, including in the event of a warranty claim or multiple defendants, shall fall within the exclusive jurisdiction of the French courts.

In accordance with Article L.612-1 of the French Consumer Code, every consumer has the right to refer a dispute free of charge to a consumer mediator with a view to reaching an amicable resolution of a dispute with a professional. To this end, SENHO guarantees its Customers effective access to a consumer mediation scheme.

If any article or clause of the General Terms and Conditions of Sale becomes null and void, unenforceable, obsolete, illegal or inapplicable as a result of a law, regulation or final decision of a competent court, this shall not affect the validity, legality or enforceability of the other provisions of these General Terms and Conditions of Sale and shall not release the Customer from performance of their contractual obligations.

SENHO cannot be held liable where the Customer fails to comply, in whole or in part, with these General Terms and Conditions of Sale, or in the event of an unforeseeable act of a third party or force majeure.

Without limiting the preceding paragraphs, SENHO’s liability under these General Terms and Conditions of Sale may not exceed an amount equal to the sums paid or payable in connection with the transaction giving rise to such liability, regardless of the cause or form of the action concerned.

These General Terms and Conditions of Sale and Use govern all use of the website and the services offered on it.

We reserve the right to amend these General Terms and Conditions of Sale at any time, at our discretion and without prior notice. We therefore invite you to read this document carefully each time you place a new order. The applicable General Terms and Conditions of Sale shall be those in force on the date the order is placed and shall apply without restriction or reservation to all sales of products listed in our catalogue published on the SENHO websites. By continuing to use the website following such amendments, you signify your acceptance of the new General Terms and Conditions of Sale.
